Evidence and information

 

You will need to provide us with an overview of the accident to include details of your injury, where the accident occurred, the time and date of your accident, details of any witnesses and any medical information that you already have on your injury.

 

Assessment of a successful outcome

 

A solicitor will be provided and will hold an interview with you to determine any other factors such as was the accident within three years and whether the accident was your fault or not. You will also be required to provide continuous updates as to your treatment and recovery.

Your solicitor will send a letter of claim to the person or company who you are claiming against to inform them of the claim. They are legally required to respond to the letter of claim within 21 days; they will then have three months to seek evidence to prove that it wasn't their fault. Evidence found by both parties must be exchanged to ensure a fair case.

An investigation will be carried out by your consultant which will look at gathering photographic evidence of both your injury and of the place where the accident happened, they will also need any receipts of the expenses that you have incurred as well as a police crime number if you have one.

Medical examination. Your personal consultant at Injury claims will arrange a medical examination of your injuries - this is an important part of your claims process.

Your solicitor will put together a schedule of losses which lists everything that you are claiming for which includes, losses incurred, expenses incurred, treatment costs and the level of your injury, a total compensation amount will be decided between yourself and your solicitor based upon the schedule of losses.

The person who you are claiming against will then have the opportunity to admit liability and compensation will be awarded to you, if liability is denied then the claim will progress to a court proceeding.

The whole process could take between 6 months to a year in most cases; however, this will depend upon the types of injury and the law that was breached as well as many other variants.
