Injury Claim

We like to give our clients as much advice as needed before they choose to go ahead with the claim and one important area, which we like be clear about, is the type of compensation claim available. The two types of claims in relation to injury claims are general damages and special damages which are legal terms to distinguish between damages for which you are claiming for and the level of injury that has occurred as a direct result of the accident.

General damages are the compensation amount that is claimed for injuries such as any pain or suffering incurred or any actual physical injures. Please see types of injury for examples of injures that can occur due to an accident.

For this type of claim, your case will be assessed by looking into the level of pain you have suffered and the severity of injury you have sustained, we will also look at how your life has been affected by your injury such as if your day to day activities has been significantly reduced as a result of your injury and you are prevented from carrying out tasks or using skills for which you would normally be able to do so.

Your loss of earnings is another area we look at, as many people will have to had to take time off from their work in order to receive treatment and rehabilitation, this can lead to loss in earnings and so needs to be taken into consideration when assessing the level of general damages to be claimed.

The other type of damages is special damages and this relates to the expenses incurred as well as the loss of earnings. This can include things that you have needed to pay for such as care, treatment, medication and therapy. Any expense you have had to pay for, as a direct result of your accident will be claimed for under this type of compensation
