Your Injury claims assessor will make an assessment into the level of damages that they will then make a claim for. This is also something, which is undertaken in the court, and so it will provide an insight into the level of compensation that you may gain.

In court the evidence gathered will be looked at and examined as well as the detailed accounts of losses or expenses incurred as a direct result of your accident.

In doing this, the type of loss would be assessed and would arise from what law was broken that made the accident possible e.g. negligence or duty of care. Your claims assessor will look in detail as to which law has been breached whether it is by your employer, a company, or an individual.

Your consultant can give you an overview of the laws, which they have found to have been breached which may include the following:

Duty of care - This is where a legal responsibility has been placed on an individual or company to ensure the safety pf anyone who is performing any task. The person or company responsible will ensure every reasonable step had been taken to ensure that no injury could occur.

Negligence - This amounts to a breach of a duty of care to ensure that everyone remains safe

Clinical negligence - Any act or mission that falls short of a standard expected
